New Delhi [India]May 18 (ANI): The Supreme Court on Tuesday issued notice to the West Bengal state government after hearing a joint petition filed by the brother of a BJP worker who was allegedly killed by Trinamool Congress (TMC) workers, seeking directions to Went. A Special Investigation Team (SIT) is probing the alleged murders.
A two-judge vacation bench of the apex court comprising Justice Vineet Saran and Justice BR Gavai issued notice to the West Bengal government after hearing a petition filed by Vishwajit Sarkar, brother of deceased Bharatiya Janata Party activist Abhijit Sarkar and others.
The Supreme Court was hearing a petition filed by the families of two BJP supporters who were allegedly killed by TMC workers on the day the results of the West Bengal Assembly elections were declared.
Senior advocate Mahesh Jethmalani, appearing for Sarkar, told the court that Sarkar’s house was allegedly attacked on May 2. When Abhijit Sarkar and the petitioner (Biswajit Sarkar) reached back home, the BJP worker was dragged outside their house and allegedly “murdered”.
Jethmalani told the apex court bench, “It is a very serious matter. There are two eyewitnesses. The state is not taking any action when two people have been brutally murdered. This is a case that needs to be probed by the CBI or the CBI. The SIT needs to be shifted.” today.
Jethmalani said the alleged killings took place when the results of the state assembly elections were declared. One of the petitioners is the brother of a political party member who was allegedly murdered.
“There is complete inaction by the state not to act but to suppress the investigation. The brother was allegedly murdered when the election results were out on May 2. Another worker was also killed. Police. kept quiet. No one helped and they were left to die. It was at the behest of the state administration.”
The Supreme Court said that it is issuing notice to the state government.
“We issue notice. Give it to the state. We will hear it next Tuesday,” the bench said.
“When the machinery of the State fails to protect the life, liberty and property of the citizens and the investigation is carried out to help the accused persons”, the petitioner said, it is imperative that this Court be made to prevent unfair miscarriage of justice. Steps taken for the victims and their family members.
“There is a complete breakdown of law and order and the inherent indifference of the institutions, which, having sworn to act freely, have become partisan and gloved themselves at the loss of human life and the cry of a common man. are not liable. Such laxity and lack of investigation will result in failure of justice and promote the rule of law.”
The petition states that the state government is failing in its duty to protect its people and impartial action cannot be expected from its agencies. “When allegations are made against the police force of the State, it thus becomes imperative to hand over the investigation to an independent agency. This will also reassure the relatives of the deceased and ultimately lead to a just and credible outcome,” the petition said. .
When an ordinary citizen complains against a powerful administration, any indifference, inaction or slowness shown in defending his authority guaranteed in law will cripple and destroy the trust built in the judicial system. It is to be seen that the accused persons are punished and the power of the State is not used to protect itself and its men,” the plea said.
It said the law enforcement agencies are refusing to register FIRs and are refusing to accept the statements of the victims.
“Law enforcement agencies are getting signatures on blank pieces of document to manipulate the versions and thereby allow the accused to go free,” the petition said.
He said the accused named in the complaints were not being arrested and that the late move in the name of investigation was “just a sham to protect the ruling party cadre”.
He also said that the law enforcement agencies are deliberately delaying the initiation of the investigation so that by that time all evidence is destroyed or cleared.
“The role of the ruling party in power needs to be probed as its party cadre is at the forefront of vengeful violence,” the petition said. (ANI)
